Onderhavige algemene verkoopsvoorwaarden (“Voorwaarden”) zijn van toepassing op elke bestelling die geplaatst wordt door een bezoeker van deze website (de “Klant”). Bij het plaatsen van een bestelling via de webwinkel van Obsidian Gallery BV aanvaardt de Klant deze Voorwaarden uitdrukkelijk, en stemt hij in met de toepasselijkheid van deze Voorwaarden, met uitsluiting van alle andere voorwaarden. Bijkomende voorwaarden van de Klant worden uitgesloten, behoudens wanneer deze voorafgaandelijk, schriftelijk en uitdrukkelijk door Obsidian Gallery BV aanvaard zijn.


1. Overeenkomst
De koopovereenkomst komt tot stand na aanvaarding van de bestelling door de Klant (de “Overeenkomst”).


2. Eigendomsvoorbehoud Zolang de Klant de totale prijs van de bestelde producten niet heeft betaald, blijven deze eigendom van Obsidian Gallery BV.


3. Leveringstermijn
De leveringstermijn van de bestelde producten wordt op de website aangegeven per product. Indien geen specifieke termijn wordt vermeld, bedraagt deze maximaal 30 dagen vanaf de aanvaarding van de bestelling door de Klant.


4. Prijzen
Alle vermelde prijzen zijn uitgedrukt in EURO, en inclusief BTW. De aanbiedingen en de prijzen zijn geldig gedurende de periode vermeld in de catalogus of op de website.


5. Betalingsmogelijkheden
Obsidian Gallery BV aanvaardt de volgende betalingsmogelijkheden: Visa, Mastercard, Amex De kredietkaart wordt slechts gedebiteerd wanneer het bestelde product werd geleverd.


6. Verzakingsrecht

De artikelen VI.47 tot 53 van het Wetboek van economisch recht, laat de consument toe binnen de 14 kalenderdagen te rekenen vanaf de dag volgend op de dag waarop de Klant of door de Klant aangewezen derde fysiek bezit neemt van het goed (behalve in bijzondere omstandigheden voorzien in boek VI van het Wetboek van economisch recht). De producten dienen onverwijld, en in elk geval binnen 14 kalenderdagen na de dag waarop de Klant zijn beslissing om de overeenkomst te herroepen heeft meegedeeld aan Obsidian Gallery BV, door de Klant te worden teruggezonden naar Obsidian Gallery BV, op bovenvermeld adres, waarbij de Klant zelf de verzendingskosten ten laste neemt.

Ingeval de Klant van dit verzakingsrecht gebruik maakt, betaalt Obsidian Gallery BV de eventueel reeds betaalde prijs terug aan de Klant binnen de 14 kalenderdagen na de dag waarop Obsidian Gallery BV wordt geïnformeerd door de Klant van zijn beslissing tot herroeping.

De Klant kan de producten die niet overeenkomstig zijn bestelling werden geleverd of die beschadigd worden geleverd binnen een termijn van 14 kalenderdagen aan Obsidian Gallery BV terugsturen. In dit geval zal Obsidian Gallery de verzendingskosten, alsook de eventueel reeds betaalde prijs, binnen de 30 kalenderdagen terugbetalen.


7. Verzendingskosten

Obsidian Gallery verzendt de producten in België voor de vaste prijs van 10 euro. Voor verzending naar Europese landen en de U.K. wordt 20 euro aangerekend.
Voor alle andere landen wordt 30 euro aangerekend


8. Klachten

Klachten betreffend de bestelde producten kunnen worden gericht aan: Obsidian Gallery BV, per aangetekende post op bovenvermeld adres of per e-mail met ontvangstbevestiging.


9. Toepasselijk recht en bevoegde rechtbank

Deze Overeenkomst wordt uitsluitend beheerst door het Belgische recht. Alle geschillen die uit of met betrekking tot deze Overeenkomst ontstaan, zullen uitsluitend worden beslecht door de Nederlandstalige hoven en rechtbanken van Brussel.

Categories of personal data processed and purpose of processing. Obsidian may process certain personal data relating to you, such as your first and family names, email address and the company to which you belong when you contact us via our contact forms to request specific documents. During the request process, you acknowledge and agree that these personal data may be collected and processed for the purposes of answering your request. Obsidian will not retain such personal data for a longer period of time than necessary or process it for marketing communication.



In addition, we use cookies for technical, functional and analytical purposes, as described in the “Cookies” section below.

Transfers of personal data. Obsidian may transfer your personal data to suppliers within countries or territories ensuring an adequate level of protection, including for Website hosting purposes. We make use of “social plugins”, i.e. plugins for social networks, including particularly the Facebook “Share” button. The facebook.com website is operated by Facebook Inc., 1601 S. For data privacy reasons, we deliberately opted against utilising direct social network plug-ins on our website. Instead, we employ an alternative technical solution that allows you to decide whether to transmit data to the social network operators and when. Thus when you visit the Website, data are never automatically transmitted to Facebook or Instagram. Only when you actively click on the respective button yourself your web browser will connect to the servers of Facebook or Instagram, i.e. clicking on the social network’s icon indicates your consent to your browser connecting to the servers of Facebook or Instagram and sending usage data to that social network operator, whether or not you are a subscriber of such social network.



We have no influence over the nature or scope of data that social networks may then gather.
